The third working session of the Congress (Term XIII): 3 Laws and 2 Resolutions approved

With the agreement of the majority of delegates, on morning of June 21, the Congress approved 3 Laws and 2 Resolutions which include The Law on advertisement, The Law on water resources (revised,) Vietnam marinetime Law, Resolution about approving state budget settlement of 2010, Resolution about thematic monitoring on the implementation of Policy and The Law on investment for agriculture, farmers and countrysides.


​* Culture, Sport and Tourism Department will apply state management over advertisement

The Law on Advertisement prescribed that Culture, Sport and Tourism Department to take full responsibilities before the Government for the implementation of State Management over Advertisement.

Among products, commodities, service that are prohibited to be advertised, such products as tobaco, prescribed medicine, unprescribed medicine with recommended consumption limit, aphrodisiac products… manufactured milk products for kids under 12, Nutrition supplimenting products for kids under 6 month olds; milk bottles and pacififers which are also in the prohibited list. This provision of the The Law is made to ensure the benefit and proper needs of mothers and kids, also consistent with the currnet conditions. However, as for liquor pruducts, the provision is applicable only to kinds of wine with 15 degrees of alcohol concentration or higher. According to Explanation of Standing Committee of Congress, if we prohibit all kinds on wine, we will unintentionally prohibit all alcohol drink, including Beer and mild wine, some of which are good for health (Such as dinner wine, nutritional drink…). Furthermore, most of traffic accidents are cause by drivers who drink heavy alcoho. For those reasons, Standing Committee of Congress suggested Congress that the provision should be applied only for liquor with 15 degress alcohol concentration or higher.
 
Promotional activities which are inaesthetic, unsuitable for traditional history, culture, ethics and fine customs of Vietnam; hurting the prestige, honor and dignity of organizations and individuals; Advertisments which convey incorrect information or causes confusion about entrepreneurship, the ability to provide goods and services of organizations and individuals operating relavant types of business; the quantity, quality, price, utility, design, packaging, brand, origin, type, method of service, warranty period of products, registered or published goods or services will be prohibited to be advertised.
Draft law on advertisement was approved by 97.39% of delegates.
 
* Implementation of water-saving policies encouraged

With the agreements of 478 delegates’, accounting for 95,79% of the Congress’s approvement on The Law on Water Resources (revised).

According to Standing Committee of Congress, the revision applied for seawater of internal waters and territorial sea prescribed in The Law on Water Resources (revised) is to ensure the consistency with The Law on National Borders and Vietnamese Marinetime Law to be considered and approved in this working session, specialized laws and statements of the State to comfirm the sovereignty of our country in accordance with with the International Convention on the The Maritime Law of 1982 and the international treaties. The revision in this Law should not be applied for mineral water and natural hot water which have been revised in the Mineral Law.

The Law on Water resources (revised) determine the responsibilities of organizations or individuals who invest in projects including constructions of mining, use of water resources or waste water discharged into usable water supply in the area for coordinating with local governments to get the opinions of the community representatives and organizations or individuals involved in the schemes of water resource exploitation and use, wastewater discharged into water sources of the project; submitting the dossier of the project to competent authority for the decision on investment. Organizations and individuals must also disclose information about the exploitation and use of water resources, wastewater discharged into water sources of the project and the effects that possibly harmful to the community before deploying the project.

To encourage all organizations and individuals to implement the Water-Saving Policies in recycling qualified waste water, the Law stipulating State investment and encouragement towards organizations and individual to invest in researchments, science applications and hi-tech to manage, protect and develop water resources, exploit and use economically, effectively Water Resources and wastewater treatment qualified for reuse handle saltwater, brackish water into fresh water; collect and use rainwater; complete artificial groundwater, restore water sources which is contaminated, degradated and depleted; prevent, avoid, mitigate damage caused by water.

* Enhancing the direction of state budget settlement 

On the basis of receiptive and explanatory reports presented by Standing Committee of Congress, the delegates approved the Resolution of State budget settlement of 2010 with the following index: total revenue of State budget of 777,283 billion Vnd, including brought forward revenue from 2009 to 2010, budget remainder revenue of 2009, investment mobilization of State budget complied with the regulation prescribed in Law on State budget. The total state budget balancing expenditure is 850,874 billion Vnd, including brought forward expenditure from 2010 to 2011. State budget deficit in is 109,191 billion Vnd, accounting for 5.5% of Gross Domestic Product, excluding local budget remainder. State budget deficit financing including domestic loan is 68,967 billion Vnd; foreidn loan is 40,224 billion Vnd.

Receiving all opinions of delegates, Standing Committee of Congress suggested enhancing the direction of State budget settlement, ensuring right order, procedure of implementation and improving the quality of State budget evaluation; overcoming late budget delivery in order to efficiently use State budget, enhancing tax management, improving the quality of inspection and strictly handling tax violation, minimizing tax arrears. The Government is assign to direct central and local authorities to have a look over and overcome outstanding issues stated in the Verification report no. 93/BC-KTNN dated May 10th, 2012. Violations of state budget management and operation must be promptly handled and relevant individuals or organizations in charge of should also be criticized, in the mean time, the results should be reported to the Congress when the report on State budget settlement of 2011 is submitted.
 
* Improving policies, laws and the efficiency of public investment in agriculture, farmers and rural areas.

Agreeing with the content of monitoring results of Standing Committee of Congress on the implementation of policies and legislation of public investment in agriculture, farmers and rural areas, 96,99% of delegates approved  the resolution on improving the effectiveness and implementation of its policies and legislation of the investment.

The Congress decided to increase investment in agriculture, farmers and rural ereas from the state budget in accordance with the spirit of Resolution of the 7th Central Executive Committee Conference of Congress term X, guarateeing that the capital of the next 5 years would double that of the previous period. It is to increase the investment in agriculture and rural ereas development for key locals, agricultural products and commodities with high competitiveness, to ensure national food security for poor and mountainous provinces and poor districts which are facing difficulties in attracting investment from other sources of capital according to Resolution 30 and Program 135 of the Government.

It is priozitized to focus on investment in research, scientific - technology application in agriculture. The irrigation system, the canal serving irrigated areas of two rice crops, areas of industrial and material plants and collective aquaculture should be completed soon. the system of river dikes, sea dikes, levees, anchorage area, avoiding storms, salt prevention works, flood discharge, retaining freshwater, drainage which can adapt to changing climate conditions and rising sea level should be built and reinforced; the disaster warning system of the country and the rural transport system should be improved; electricity infrastructure which adequately supply for production and activities in rural areas should be developed. Mechanisms and policies that are suitable for the development of foresty material areas, investment for forestry plantation and protection should be established; the land which agriculture, land capital of forestry and agriculture companies and forest management should be checked so that inefficiently used land capital would be allocated to plantation enterprises and individuals.

It is to check, revise and supplement the policy of investment attraction, especially about collecting land use and land lease fees, conversion of land use purposes, the enterprise income tax for enterprises, agricultural cooperatives that have projects, projects of investment in agriculture, rural areas, especially in the remote, mountainous arears and provinces alongside national border, island areas facing difficulties in economic-social conditions, the projects of investment in high technology applications, the investment in developing the processing technology of agricultural products which bring high added value. It is necessary to attract the participation of economic sectors in a number of projects which are still relying heavily on state budget. It is to gather funds and mobilize internal human resources to build new rural areas; implement the integration of resources, the national target programs in locals. Some new criteria for rural and other targeted programs should be checked and revised in accordance with the reality and economic-social conditions in different regions
 
At the working session this morning, with 99.2% of agreement of delegates, the Congress approved Vietnam Maritime Law ./.
