On 05/24/2013, People's Committee of Dong Nai Province promulgated Directive No. 17/CT-UBND on inspection of electrical equipments, computers used for transferring and storing confidential information on the state in Dong Nai Province.
The status of confidential information and documents leak of the Party and State has occurred in some places, resulting in serious consequences in some cases; for which one of the reasons is the installation of illegal electric chips in telecommunication equipments and computers. Installing illegal spy-microchip on electric telecommunication equipments and computers is called Backdoor, easily made by the manufacturers. The purpose of installing backdoors is to steal and transmit data as desired by the creators. Illegal installation is often seen in electronic and telecommunication equipments such as 3G USB, 3G Wecam, mobile phones, computers and other information technology equipments. Current Vietnamese technology industry itself has not produced electric telecommunication equipments and computers, which are mainly imported.
According to the Director of Information Security of Microsoft Asia, Vietnam has 3 risky categories found in the second quarter of 2012. The most popular category in Vietnam is unwanted software that affects 64% computers; the second is malicious backdoors in electronic chip (Backdoor), affecting 41.3% computers; the third is computer worm /virus, affecting 30.1% computers. Those facts show that the security of the country is possibly threatened. Hackers can take these advantages to steal confidential information of the state. To prevent the status of confidential information and documents leak of the state, the provincial People’s Committee has promulgated the Directive:
Directors of departments, branches and People's Committees of districts, Long Khanh town, Bien Hoa City are responsible for the following: Making a list of electrical devices, electrical telecommunication devices and computers used for transmitting and storing confidential information of the state (as defined in paragraph 1 of Article 09 of the Cipher Law) and sending the report to Dong Nai province Public Security in order to coordinate with each other to conduct investigation; assigning officers to use and manage those equipments, establishing troubleshooting process, coming up with policies and measures to strictly manage means and devices containing the state’s confidential information; raising people’s awareness of protecting the state’s information security in the province; studying the Ordinance on the Protection of State Secrets, Cipher Law, Decree No. 33/2002/ND-CP dated 28/03 of the Government clearly stating implementation of the ordinance to protect the state’s secrets, Decision No. 34/2009/QD-UBND of PPC dated 21/05/2009 on promulgating regulations to ensure information safety and security in the field of information technology application of the administrative agencies and units of in Dong Nai Province.
The Directive expressly states personal user shall: strictly manage and monitor devices and equipments containing the state’s confidential information; comply with current regulations on state’s information protection, safety and security. All information related to the state’s secrets transmitted and stored on the media, electronics and telecommunication equipments must be encrypted in accordance with the cipher regulations; not either use electric devices, computers with Internet connection (including connected and not connected time) to compose, store, copy or print documents containing the state’s secrets or use the internet to copy the state’s secrets from one place to another; not store confidential documents and texts on personal computers and other unsafe storage devices; not bring radio microphones and mobile phones, 3G device, devices with recorder and signal receiver to secret meetings in any way, shape or form; not exchange the state’s secrets through radio, mobile phone, fax on the internet in any form; not use technology communication equipments sponsored or donated by foreign organizations or individuals on public duty without prior test or inspection.
Besides, the PPC assigned the Provincial Public Security to preside over the establishing of inspecting procedures and inspection stamping; provide managing and using units with guidelines on the state’s confidential information protection; prepare technical infrastructure and manpower to implement on conducting investigation; coordinate with the Department of Information and Communications and relevant units to provide guidelines on investigation and encourage the units, localities to implement this Directive and report the results to the PPC.
The Department of Information and Communications must coordinate with the Office of the Provincial People's Committee, the provincial Public Security and relevant units to conduct the inspection on the implementation of Directive at every unit. The inspection plan is integrated into the annual inspection plan under the Decision no. 34/2009/QD-UBND of the dated 21/5/2009 PPC on promulgating the regulations to ensure information safety and security in the field of information technology application of the state’s administrative agencies and units in Dong Nai Province.
Chairmen of PPC of districts, Long Khanh town, Bien Hoa City must closely coordinate with the provincial Public Security to strictly implement the Directive in order to ensure the state’s information protection and significant achievement.
