Training in Real estate business and Housing Laws and guiding documents for implementation

On 10 September morning, at the provincial Square, the Department of Construction held a training conference in Real estate business and Housing Laws and guiding documents for implementation for the key cadres of provincial to grassroots levels and relevant units. Mr. Vu Van Phan – Deputy Director of Department of Legislation – Ministry of Construction introduced and deployed two important Laws mentioned above. Mr. Ao Van Thinh – Vice President of the provincial People’s Committee attended and stated at the conference.

The training contents included the introduction and deployment of Real estate business Law and Housing Law adopted by the 11th National Assembly in the eighth meeting session of Novemver 29, 2005; Decree No 90/2006/NĐ-CP on September 6, 2006 by the Government setting and guiding in details the implementation of Housing Law; and Circular No 05/2006/TT-BXD on November 11, 2006 by the Ministry of Construction on how to carry out some contents in Decree No 90/2006/NĐ-CP on September 6, 2006 by the Government setting and guiding in details the implementation of Housing Law.

The Real estate business law was adopted by the the Socialist Republic of Vietnam’s 11th National Assembly during the 9th meeting session on June 29 2006. On July 12 2006, the President signed a decree to proclaim the Real estate business law. In recent years, our real estate market especially the land market has made considerable developments, largely contributing to our country’s socio-economic motivation, changing the face of urban and rural areas, and contributing to the economic structure transfer in the direction of national industrialization and modernization. Besides positive aspects, our real estate market’s activity and management during past time have shown their negative aspects and many urgent matters in social life have emerged.

The conference’s view

The Real estate business law comprises 6 chapters and 81 clauses – promulgated in our country for the first time will actively contribute to the real estate development process, positively regulate the real estate market in an explicit and open way and at the same time increase the State’s effectiveness in this field. The Housing Law which is composed of 9 chapters and 153 clauses and approved by the 11th National Assembly in the 8th meeting session on November 29 2005, is the most important and complete law on housing. This law defines ownership, development, using management, transaction and the state management in housing. The law applies to objects including organizations and individuals concerning ownership, development, using management, transaction and the state management in housing.

Stating at the conference, Mr. Ao Van Thinh - Vice President of the provincial People’s Committee suggested that after the training conference all branches and levels pay attention to urgently steering the matters relevant to Real estate business and Housing laws, in particular pay special attention to the thorough study of the concerning Circular’s contents and documents, to putting the regulations on housing and land in the province into force early. At the same time, they have to positively popularize widely and deeply the Laws so that everybody can understand those and have to direct and examine to timely correct the shortcomings.
