In the face of the situation of many enterprises in the province experiencing difficulties in production, the problem of pay, bonuses and the regime, the year-end policy is being paid attention to many workers (domestic workers). Trade unions and functional sectors are grasping the situation of labor protection of animal rights.

Workers bewildered when they lost their jobs

Over the past week, dozens of workers of Minh Giang Garment Co., Ltd (Bien Hoa City) have lost their jobs suddenly because the company suddenly closed and the business owner could not contact. Earlier, on Dec 9, workers went to the provincial Trade Union Legal Consultant Center (part of the provincial Labor Federation) to ask for support. According to many employees, over the past time, they are very understanding and sharing difficulties with the company so still go to full employment. However, the owner of the enterprise fled and the employer is owed wages for about 2.5 months. In addition, the social insurance amount for more than 2 months now the company does not pay for the insurance policy.

Mr. Nguyen Huu Yen (from Thanh Hoa province) has worked for more than 1 year at the company said that over many days, he often lost sleep because of job losses and enterprises owed unpaid wages. Previously, when working normally, including increased shifts, he had an income of 9 million/month to care for his family and feed his children to school. Now without a job and an income, he does not know how to manage, while his wife works as a part-time worker on low incomes.

According to Yen, in August 2022, the company announced difficulties should be owed to the employee's salary. Knowing that enterprises have few orders, the majority of employees working at the company still share and go to work normally. In September and October, the new company pays 1/2 month salary per person. By November, the solar sector had not received any pay, the business closed, fled. “If the business owner is still not able to contact, the salary, the regime, our policies do not know when new, while at the end of the year it is difficult to apply for a job" - Mr. Yen said.

With the same view, Mr. Nguyen Van Cu (from Thanh Hoa province) for many days is also in a nervous mood when Tet approaches but wages, jobs are not available. He said that a couple of weeks ago, the workers were still working normally. On Dec 5, the enterprise notified workers to leave work so that the technical department can check the machine. By the morning Dec 6, workers went to work and the company was closed. Too surprised about the above incident, Mr. Cu and many employees sought the authorities for support and reclaim their rights.

According to Mr. Cu, among the employees working at the company, some are single mothers, there are people staying in accommodation and difficult circumstances. All workers are counting on wages to cover the upcoming Tet holiday. “Currently, many workers are breadwinners, but they are old, so it is difficult to get a job. If business owners flee, the risk that this year we will lose Tet and the daily living expenses do not know where to compensate. We hope to organize trade unions, functional sectors soon in order to timely support the workers" - he said.
According to initial verification from the Police of Tam Hiep Ward (Bien Hoa City), the director of Minh Giang Garment Co., Ltd is Vietnamese and Korean boss has moved things to other places from the evening of Dec 03. Currently owes rent of more than 660 million VND and wages of 20 workers with an amount of nearly 250 million. Previously, through listening to the reflection of the Labor Union, the Provincial Trade Union Legal Advisory Center provided legal advice and assistance to the organization to send an application to the relevant authorities for settlement.
Need to protect the rights of workers

The situation of business owners who fled or cut off contact with workers has taken place in recent years. Previously, in 2018, in Dong Nai, two foreign-invested enterprises including Cho Won Co., Ltd. (Nhon Trach district) and KL Texwell Vina Co., Ltd (Trang Bom district) also fled, causing thousands of unemployed workers and life to be difficult. The local government then promptly went to support workers with money back home to welcome Tet with their families. The common point of the above enterprises is that they owe wages and social insurance of the employees.

In addition, in the past time, many enterprises terminate labor contracts or let the workers leave work contrary to regulations, while implementing regimes and policies that are not guaranteed. Recently, 80 employees at S-Print Inc. Co., Ltd (Long Thanh district) have stopped working. The plant requires enterprises to clearly inform about the time of unpaid leave; ensure the regime according to the law when they have to stop work due to lack of orders... After working with the interdisciplinary working group, the enterprise commits to comply with the provisions of the law when the employee stops working. Accordingly, the solar energy has returned to normal work.

In fact, in the last months of 2022, besides enterprises that are really difficult on orders, do not have production materials and need to share difficulties, there are still enterprises taking advantage of the situation to lay off older workers by terminating labor contracts. If this still happens, the employees will be very disadvantaged, especially those who have worked for a long time with a high salary.

According to the Department of Labor, War Invalids and Social Affairs, the implementation of labor law policies in enterprises is still limited, such as: the proportion of enterprises participating in labor law training is not much; Some businesses only care about profits, so they still make mistakes in the implementation of labor law provisions... Accordingly, the Department has coordinated with related sectors to promote propaganda and training for business owners. At the same time, inspect and examine enterprises that violate labor laws. In addition, instruct businesses to fully implement policies when reducing working hours, arrange for employees to work alternately if orders decrease at the end of the year.
