In order to put the transport business into order, the Minister of Transport has issued regulations on organization and management of transport activities by car and road transport support services (known as Circular No. 12) has created a clear and transparent legal corridor, facilitating business activities in the transport market, overcoming shortcomings and inadequacies according to the provisions of the law before.
Tighten regulations
Circular No. 58/2020/TT-BCA dated June 16, 2020 of the Minister of Public Security on the process of granting, revoking, and registering for the number plates of motorized vehicles stating that motorized vehicles, and vehicles operating in transport business must be changed to number plates with yellow color before December 31, 2021. The change of number plate color will support the competent forces in management and better distinguish business vehicles, especially creating the fairness and equality among the enterprises.
Traffic Police Department of the Provincial Public Security said that up to now, most of the vehicles out of the total of more than 50,000 vehicles in the province have completed the change of number plate color. The unfinished cases belong to the individual or companies having a small number of vehicles. After the above time, if the transport business vehicles have not changed their number plates from white to yellow, they will be fined from VND2 million to 4 million for individuals, and from VND4 million to VND8 million for organizations that are vehicles owners, according to Decree No. 100/2019/ND-CP dated December 30, 2019 on sanctioning of administrative violations in the field of road and railway traffic (referred to as Decree No. 100).
Similarly, according to the Decree No. 10/2020/ND-CP dated January 17, 2020 of the Government stipulating the business and conditions for transport business by vehicles (referred to as Decree No. 10), passenger cars from 9 seats (including the driver) or more and cargo trucks by containers, tractors must be installed with cameras to record and store images on the vehicle during the vehicle's traffic route. This image data will be provided to the police, traffic inspectors and license issuing agencies to ensure the open and transparent surveillance.
Decree No. 10 stipulates that the images from the vehicle-mounted camera must be transmitted with a frequency of 12-20 hours (equivalent to 3-5 minutes/time of data transmission to the transport service enterprises and transmitted to the competent state management agency). Specifically, from December 25 to December 31, 2021, transport service enterprises register to create an account and conduct a pilot data transmission. From January 1, 2022, transport service enterprises will transmit data according to regulations.
Another requirement that is also valid until December 31, 2021 is that transport service vehicles are required to have seat belts in all passenger positions (except for intra-provincial buses), including seats and beds according to Decree No. 10. Thus, according to the provisions of law, vehicles participating in passenger transport must meet all conditions for participating in traffic, in which it is mandatory to have seat belts at all seats and beds. If the vehicles involved in the passenger transport business do not have seat belts installed, the driver will be fined from VND600,000 to VND800,000 according to Article 23 of Decree No. 100.
Do not postpone the implementation
According to statistics from the Department of Transport, the province has more than 500 businesses, cooperatives and individuals licensed to operate transport services with nearly 50,000 vehicles. In which, freight transport accounts for nearly 45,000 vehicles, passenger transport under contract with more than 6,000 vehicles, fixed passenger transport with nearly 300 vehicles, and public passenger transport by bus with 350 vehicles.
Mr. Le Van Duc, Head of the Vehicle Management Division, Department of Transport said that recently, the Department of Transport had worked with the transport service enterprises and requested to urgently install cameras on passenger cars as regulated in Decree No.10, because the deadline is very near. However, the number of vehicles installed with cameras accounts for a very low percentage of the total number of vehicles that have to be installed, which is a difficulty in performing the Decree.
In fact, this regulation has been implemented for a long time, the Government has facilitated in delaying the installation deadline to the end of December 31 instead of July 1, 2021 as previously prescribed. But the transport service enterprises for many reasons to refuse, not to comply, will be sanctioned in accordance with regulations.
Regarding this issue, the Government Office has just issued a document conveying the direction of Deputy Prime Minister Le Van Thanh on the implementation of regulations for transport service vehicles. The Deputy Prime Minister directed the Ministry of Public Security, the Ministry of Transport and the local People's Committees to urgently implement the regulations on installing cameras on transport service cars according to Decree No. 10 and the Government's direction in Resolution No. 66/NQ- CP dated July 1, 2021 on thematic meeting on law-making in June 2021.
According to Resolution No. 66/NQ-CP, the Ministry of Public Security is assigned to direct the traffic police force; The Ministry of Transport directs the traffic inspection force according to their assigned functions and tasks, to step up patrols, control and strictly handle according to law provisions for vehicles participating in transport service activities but not comply with regulations on camera installation.
Chief Inspector of Traffic, Department of Transport Nguyen Phan Trong said that the Department of Transport has just issued a document directing the traffic inspector force to inspect and handle the transport service vehicles which have not installed a camera after December 31, 2021. The inspection is carried out at the bus stations, vehicles that do not comply will be fined in accordance with regulations.
