Vietnam Indochine Co., Ltd needs to cooperate with grassroots trade union to solve complaint letters of its laborers

In early August, Dong Nai Department of Labors, War Invalids and Social Affairs received the complaint letters of more than 20 workers from Vietnam Indochine limited company, which related to such problems as: not paying senior workers when they were transferred from Nahnoom Co., Ltd; making monthly deductions from workers’ salaries but not paying social insurance premiums for them; not making clear labor contracts, and complicated procedures for vacation and sick leave, etc.

The company’s social insurance report

 

On September 24, 2010, inspectors of Dong Nai Department of Labors, War Invalids and Social Affairs and the provincial Labor Union had a working session with representatives of Indochine limited company. The working session was attended by Ms Ngo Phuong Mai, human resource manager of Indochine limited company, Mr. Nguyen Khac Trieu from the provincial Labor Union, and two inspectors of Mr. Cao Duy Thai and Ms Nguyen Thi Kim Thuy. After reviewing the company’s explanation, documents and labor contracts, the delegation of inspectors asked the company to conduct some regulations on the problem of not paying senior workers when they were transferred from Nahnoom Co., Ltd. In particular, the company would join hands with grassroots trade union to explain that workers would receive severance allowance (including the working period at Nahnoom Co., Ltd) fully and in time when ceasing to work. The company had paid social insurance for its workers by August 30, 2010. Besides, the delegation of inspectors also suggested that the company should clearly explain social insurance regimes to its workers. The company should carry out signing labor contracts with its employees in accordance with the regulations as stipulated in Articles 27 and 29 of Vietnam Labor Law, Decree No.44/2003/ND-CP and Circular No.21/2003-TT-BLDTBXH of the Ministry of Labor.

The working session concluded that the complained content was totally true. On August 30, 2010, the company also timely adjusted and paid social and medical insurance fees for its workers according to the provisions of law. However, in the complaint settlement process, the company has not yet closely collaborated with grassroots trade union to clearly explain the problem to its laborers, which led to the discontent among them. Therefore, the most important thing is that the company should closely cooperate with grassroots trade union to create a harmony relationship with its employees, satisfying its workers’ needs and expectations and building stable relationship in the production process. 

On the other hand, the company has its grassroots trade union but this unit has not put into operation yet. In the upcoming time, the provincial Labor Union will guide Long Thanh district’s Labor Union to strengthen the Executive Committee of the company’s grassroots trade union, establishing a stable relation between the laborers and labor users.
