Strengthen inspection of the implementation of labor laws at enterprises

The provincial inter-sectoral inspection team headed by the Department of Labour, Invalids and Social Affairs will inspect the implementation of occupational safety and health work at an enterprise in the province in 2022.


Many enterprises still make mistakes

At the end of 2022, the provincial interdisciplinary inspection teams directly inspected, guided and supported enterprises to well implement regulations on labor law. In which, attention is paid to the salary, bonus and welfare regimes of employees... However, besides the enterprises that perform well, there are still businesses that are indifferent, avoid, do not strictly comply with the Labor Law in the process of production and business organization. Faced with the above situation, the delegation suggested that businesses quickly overcome to ensure the interests of employees as well as build stable labor relations.

Specifically, a reality check at Xin Guan Xing Vietnam International Co., Ltd (Long Thanh district) in December 2022 showed that this enterprise rebuilt the regulations on salary and bonus payment not in accordance with regulations of the Labor Law 2019. At the same time, periodical health check-ups have not been organized for employees. In many factories, the implementation of occupational safety and health is still sketchy, many workers are not equipped with labor protection when working. Meanwhile, with the operation nature of enterprises specializing in wood production, workers directly operate many very dangerous machines.

At Uniwin Vietnam Co., Ltd (Nhon Trach district), in 2022, enterprises have not yet developed labor rules, ladders, salary tables, regulations on salary payment and regional minimum wage adjustment for employees. In addition, enterprises do not implement democracy regulations at the grassroots in the workplace, hold periodic dialogues according to regulations. In 2022, the number of employees who quit their jobs is 1,700 people, but enterprises do not review and pay severance allowances to employees. In addition, the collective labor agreement has not been negotiated and signed yet. With the above violations, the inspection team recommends that enterprises quickly overcome, not to prolong. In addition, enterprises need to develop labor rules and register with Dong Nai Industrial Zones Authority.

Through inspections at enterprises, the province's inter-sectoral inspection team has examined records and papers related to policies for employees; at the same time, directly down to the workshop to survey the working environment, ensure occupational safety and grasp the employment situation and income of employees, especially salary and bonus issues. The delegation has guided and supported enterprises to well implement the provisions of the Labor Law, Trade Union Law, Social Insurance...

Strong sanctions are needed.

Over the past time, the Department of Labor, War Invalids and Social Affairs has organized many conferences to disseminate and educate labor laws for employers and employees. Particularly in 2022, the Department held 8 conferences to implement the regional minimum wage and the provisions of the Labor Law for more than 1,750 people at enterprises in the province; implementing instructions for more than 1,000 enterprises to register for an account to report the results of online self-inspection on the implementation of the Labor Code; coordinate with the provincial Social Insurance to penalize 75 enterprises that owe social insurance. In addition, the Department has coordinated with other departments and branches to inspect and examine the observance of labor law regulations at 13 enterprises.

The Department of Labor, War Invalids and Social Affairs has also coordinated with related sectors and localities to synchronously implement many solutions to raise the awareness of compliance with labor law regulations for employers and employees in all types of enterprises. Thereby, contributing to building a harmonious and stable labor relationship. However, the current implementation of labor legislation in many enterprises still has many difficulties and problems. In some enterprises, although they have implemented regulations more favorable to employees, they have not included them in the collective labor agreement of enterprises.

Through the inspection at enterprises of the Department of Labour, Invalids and Social Affairs, it was found that the implementation of labor legislation is still formal, not really effective. The reason is that the percentage of enterprises participating in labor law training is not much, especially business owners rarely attend, but most of them are assigned to the department in charge of human resources to participate. Some enterprises focus on production and business, not really paying attention to the provisions in the Labor Law, leading to mistakes affecting labor relations.

Worker Le Thi Thu Thuy (hosting in quarter 6, Long Binh Ward, Bien Hoa City), one of the workers who lost her job at the end of 2022, said that over the past time, many workers lost their rights due to limited awareness of labor law, so they could not protect their legitimate interests. In addition, the propaganda and dissemination of labor legislation has not yet reached the employees. Meanwhile, the situation of enterprises that owe salaries and let employees leave work in contravention of the law still takes place and employees are the ones who suffer many disadvantages.

At the Workshop to discuss difficulties and obstacles in the process of implementing the provisions of the Labor Code at the end of 2022, the Department of Labour, Invalids and Social Affairs stated the shortcomings and current situation of violations of the Labor Code and proposed solutions to overcome them in 2023. Deputy Director of the Department of Labour, Invalids and Social Affairs Nong Van Dung said that the implementation of labor legislation needs serious coordination and compliance with the regulations of both enterprises and employees. In the coming time, the Department will strengthen labor law training for owners of enterprises and grassroots trade unions to master the regulations and perform well at enterprises. At the same time, organize dialogues with business owners to understand the situation and solve problems in a timely manner.

According to trade union officials, in order to limit enterprises' violations of labor laws such as: deliberately avoiding the implementation of legal provisions in labor and production organizations; For employees to quit their jobs illegally, deliberately dismiss elderly workers and owe wages, social insurance, etc., functional sectors need to promptly inspect and have many strong sanctions to correct the above situation and promptly protect the interests of employees.
