Obeying employment law is an important requirement for any manufacturing businesses within the province. However, the last inspection visit to Halla Vietnam Co. Ltd in Nhon Trach 2 Industrial Park to inspect how the employment law has been enforced according to the Decision no. 317/2008 by Dong Nai People’s Committee shows that the company has breached most stipulations of employment law. Halla is a 100% Korean-invested company, which has been granted the business license since 2006.

Mr. Nguyen Phuong Nam, an expert from the Department of Labor, War Invalids and Social Affairs said: “Halla has violated employment law many times. We have inspected them, warned them or even fined them but they have made no changes.” On March 26, 2009, Halla was inspected by Ms. Mai Thi Tuyet, Deputy Inspector and Inspection Team Leader. She demanded that Halla handle its 13 violations and asked it to present a report to the Department of Labor, War Invalids and Social Affairs on April 26. However, until July 15, 2009, when we accompanied the inspection team to Halla to conduct inspection and support its employment law enforcement, we discovered the previous inspection minute, which was stamped “Closed” on March 26 2009 being kept in the file cabinet. None of 13 proposals by the previous team has been followed and no reports were sent to the inspection committee”.
Halla currently has 101 employees, including nine foreign ones but only four of them are licensed employees. The inspection tour reveals that it hasn’t followed the stipulations of employment law such as the submission of periodic reports on the situation of labor use. Halla has only 86 workers, who have signed employment contracts with it but none of the contracts is made according to law. Their contracts do not refer to what kind of jobs they have to do and what kind of protective clothing they are equipped with. Halla has operated since 2006 but there are no permanent contracts among its 86 signed contracts. Especially, Halla has applied one-month probation regulation to all unskilled workers. This is clearly against the law: a six-day probation for unskilled workers. Besides, Halla has committed many other violations of food safety and hygiene and fire safety.

To deal with a series of Halla’s violations, the inspection team continued to ask it to implement the proposals that the previous team of the Department of Labor, War Invalids and Social Affairs had put forward, to facilitate the establishment and operation of the Trade Union, to set up an unemployment fund, to establish a payroll structure, to form a labor protection council, to build up a safety and hygiene network, to provide its workers with safety and hygiene training sessions and to check out its work environment with the intention of establishing a logical structure of health allowances for workers… Simultaneously, Halla must send a written report to Dong Nai Steering Committee 317 on August 17. After this day, if the Committee does not receive Halla’s report, they will carry out a full inspection.
