Strongly handle enterprises with long-standing social insurance and health insurance debts

Authorities in Dong Nai province have been implementing drastically many solutions to deal with units, enterprises, debts of social insurance, health insurance, long-term, direct impact on the legitimate rights of workers.

Provincial Social Insurance worked with provincial police on Dec 9 to deal with delayed closure, evasion of social insurance, health insurance in the province


Total debt of nearly 760 billion VND

Information from Dong Nai Social Insurance, as of the end of November 2022, the total debt for social insurance, health insurance (unemployment insurance) in the province is 759.9 billion VND, accounting for 3.2% of the total amount due.

Among them, 307 employers owe social insurance, health insurance, occupational accident insurance, interest debt for 3 months or more with the amount of nearly 230 billion VND of thousands of employees. Lilama 45-1 Joint Stock Company (Long Thanh district) owed the largest amount with more than 41.8 billion VND in 75 months. Secondary School - Le Quy Don High School (Tan Phu district) owes insurance money for the longest period - 123 months, with an amount of more than VND 2.8 billion; Thanh Lan Construction Co., Ltd (Xuan Loc district) owes 102 months with an amount of more than 884 million VND; Lilama 45-4 JSC (Bien Hoa City) owes 97 months with an amount of more than 18.3 billion VND; Hanul Line Vietnam Co., Ltd. (Long Khanh City) debt for 41 months in the amount of more than 29.5 billion VND...

The units and enterprises owe insurance money of many employees such as: ATAD Dong Nai Steel Structural Joint Stock Company (Long Khanh City) owes money for 3 months of 826 employees; Bach Thanh Ceramic Co., Ltd. (Nhon Trach district, 437 labor); Hoa An 1 Stone Company Limited (Hoa An Ward, Bien Hoa City, 294 employees).

Deputy Director of Dong Nai Provincial Social Insurance Pham Long Son said that in the face of long and lingering problems of businesses and units with insurance debts, the provincial social insurance agency has regularly urged units to pay monthly payments on time and provide a number payable amount and the amount of debt incurred monthly for each unit. To direct the management staff to keep abreast of the assigned units in charge to grasp the operation of enterprises in the province. Perform dispatching management staff to collect down the data reconciliation unit and instruct enterprises to submit and pay the money promptly, make minutes, send debt notice.

Need to be stronger

As of  Dec 8, Dong Nai Provincial Social Insurance has inspected unscheduled specialization for 20/219 enterprises and employers who owe insurance money for 3 months or more. The amount that the unit is slow to close at the time of issuing the inspection decision is more than VND 21.8 billion. Through the inspection, the units have overcome the amount of more than 11.9 billion VND.

Dong Nai Provincial Social Insurance has also issued 3 decisions to sanction administrative violations against 3 units with an amount of more than 350 million VND. As a result, two units have executed the sanction decision with the amount of more than 200 million VND; enforcement enforcement of the decision to sanction administrative violations for 1 unit with the amount of enforcement over 50 million VND.

In particular, provincial social insurance continues to strengthen coordination with provincial police agencies to exchange, provide information and organize work, inspection and interdisciplinary examination for those units with signs of delayed closure, evasion of social insurance, health insurance, insurance insurance. Thereby to consolidate the dossier and petition for criminal prosecution of units that delay closing, evading social insurance, health insurance, insurance insurance under Articles 214, 215, 216 of the Criminal Code and Resolution No. 05/2019/NQ-HTP of the Supreme Council of Judges guiding the application of a number of provisions in these laws. At the same time, report to the People's Committee of Dong Nai province and coordinate with provincial police to implement exit restrictions to avoid the status of social insurance debtors who are foreigners fleeing.

In addition to the Dong Nai Social Security Administration, the Dong Nai Department of Labour, Invalids and Social Affairs also drastically implemented solutions to recover debts.

Deputy Director of Dong Nai Department of Social and Social Affairs Nong Van Dung said that from August-2022 to September 2022, the Department has coordinated with provincial social insurance to invite representatives of 75 enterprises to work in order to check, handle insurance debt and solve the sick and maternity regime for employees. As a result of the test, 65 enterprises have overcome debt with a total amount of over 21.9 billion VND.

In November, the Department also coordinated with provincial social insurance to conduct an unscheduled inspection of compliance with the provisions of the law on insurance types at 8 enterprises, making recommendations and requirements for enterprises. As a result, there are 6 enterprises to overcome debt with the amount of more than 940 million VND. Through inspection, inspection, issued 11 decisions on sanctioning administrative violations for 11 enterprises with violations as “The employer is late to pay compulsory social insurance, insurance insurance". In which, there are 8 sanctioning decisions issued by the Chairman of the Provincial People's Committee and 3 decisions issued by the Chief Inspector of the Department of Labour, Invalids and Social Affairs with a total fine of more than 1.17 billion VND.

Recently, Dong Nai Social Insurance has issued a written report to the provincial People's Committee on the adoption of public measures in the media about employers who violate their obligations to pay insurance for employees as prescribed in Clause 14, Article 23 of the Law on Social Insurance. At the same time, it is recommended that relevant departments, sectors and localities closely coordinate with social insurance to deal with units deliberately slow to close all kinds of insurance.

In particular, it is proposed that the provincial Labor Confederation promote the role of representing employees, do well in propaganda, education, and awareness raising of the labor law in general, the law on social insurance, health insurance and unemployment insurance in particular, help employees protect their own legitimate rights and interests.
