New regulations enterprises need to pay attention

Previously, manufactured goods circulating on the market (both domestic and export) were regulated in Decree No. 43/2017/ ND-CP dated April 14, 2017 of the Government  about the goods label. Over time, the implementation has many inadequacies to be amended and Decree No. 111/2021 ND-CP dated 09/12/2021 of the Government was born (Decree 111).

From 2022, Decree 111 takes effect, among which, there are new regulations that the business community is very concerned about. Specifically, goods produced in the country for export will be labeled according to the law of the importing country, in case if the label of the product can show the origin of Vietnamese goods, the content of such origin must be guaranteed. meet relevant provisions of Vietnamese law. For imported goods, the original label of the goods must show the name of the goods, the name and address of the organization or individual responsible for the goods; origin or place of final finishing (in case the original label does not show the origin or the place where the final finishing work is performed, this must be shown in the accompanying import dossier).

In addition, with the general origin of goods (both domestic circulation and export, import) the decree allows enterprises to identify and record the origin of their goods, and also add the way of recording for the unspecified cases of origin, which is to clearly specify and transparent about where the final stage to complete the goods, such as “assembly at", “bottling" at",...

Mr. Hoang Van Than, representative of Nox Asean Co., Ltd. (Nhon Trach 6 Industrial Zone) said that enterprises are very interested in issues related to goods, labeling and self-certification of origin... When the new regulations are issued, enterprises need to grasp to avoid errors, especially when the effect is for a while but enterprises have not fully understood, from which the trouble is not worth having.

Faciliting trade for business

According to experts, the introduction of detailed regulations on the labeling of goods will be one of the appropriate solutions to help the state management agencies and the authorities improve the inspection and fight against fraud of origin of goods. Besides, also raise the responsibility of organizations and individuals producing, exporting and importing goods.

With the new regulations, enterprises, especially those related to export and import, need to be updated regularly to apply properly. In Dong Nai, from 2020, the province cooperated with the USAID TFP to implement this project locally. This is a project funded by the United States Agency for International Development in Vietnam with a capital of USD 21.7 million, implemented until 2023. Through training courses, seminars and workshops, the USAID TFP project aims to eliminate the inadequacies in customs clearance procedures, support and implement a risk-based approach at customs and specialized management agencies of Vietnam to import and export goods, thereby enhancing the implementation of the World Trade Organization (WTO) Trade Facilitation Agreement (WTO).

Mr. Nguyen Hong Son, Deputy Director of the USAID TFP project, said that since the Covid-19 epidemic has not been completely controlled, the unit has also coordinated with localities to organize seminars in the form of online. At least 5 programs have been implemented in Dong Nai. Dong Nai is one of six localities of the country selected to implement the project to facilitate trade. Through this, authorities, regulators as well as enterprises will have better access to the provisions of the law.
